Customer Terms and Conditions

INTRODUCTION

These Customer Terms and Conditions (the “Terms”) cover your use of and access to (1) www.marquisflowers.com and its associated domains (the “Retailer Site”) and (2) https://marquisflowers.com and its associated domains (our “Website” and, together with the Retailer Site, the “Sites”).  Lazy A7 Investments Inc. and its related companies (collectively, “we,” “us” or “Marquis Flower Shop operate the Retailer Site on behalf of Marquis Flower Shop division of Lazy A7 Investments Inc. (the “Retailer”).

Marquis Flower Shop provides an eCommerce platform that helps the Retailer to market and sell its products and services online. To the extent you use the Sites to browse, inquire about or purchase products or services listed on the Sites, the Terms will refer to you as “Customer.”  You are a Customer, for instance, if you order flowers or other products through the Sites.

TERMS OF SALE

Order Acceptance and Cancellation

You agree that your order is an offer to buy, under these Terms, all products and services listed in your order. All orders must be accepted by us or we will not be obligated to sell the products or services to you. We may choose not to accept orders at our sole discretion, even after we send you a confirmation email with your order number and details of the items you have ordered.

Prices and Payment Terms

Prices posted on the Retailer Site may be different than prices offered by Retailer at its physical store location. All prices, discounts, and promotions posted on the Sites are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or charges for shipping and handling. All such taxes and charges will be added to your merchandise total, and will be itemized in your shopping cart and in your order confirmation email. We strive to display accurate price information, however we may, on occasion, make inadvertent typographical errors, inaccuracies or omissions related to pricing and availability. We reserve the right to correct any errors, inaccuracies, or omissions at any time and to cancel any orders arising from such occurrences.

Terms of payment are within our sole discretion and payment must be received by us before our acceptance of an order. You represent and warrant that (1) the credit card information you supply to us is true, correct and complete, (2) you are duly authorized to use such credit card for the purchase, (3) charges incurred by you will be honored by your credit card company, and (4) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount quoted on the Site at the time of your order.

Delivery and Substitution

Every order is important to us which is why we want to satisfy each and every customer with beautiful flowers and exceptional service. Knowing that flowers are a perishable natural product and that floral arrangements and floral gifts are hand made, we make every effort to fortify our floral products and ensure the quality, accuracy and beauty of our work. Many variables determine whether a flower will last as long as anticipated or whether a designer has created something which you will enjoy. Because we constantly seek ways to bring some of these variables under our control for improved floral performance, we welcome your comments and inquiries. Also, if you are not completely satisfied with the quality of one of our products, then please contact us immediately and we will promptly take the appropriate action.

Delivery Fee:  A local delivery fee will be added to each order for each delivery address requested.  At the time of this policy the delivery charge is $13.50 plus tax.  For deliveries outside our local delivery area this fee may vary.  

Ordering on Holidays and Store Closed Days:  Our store and delivery service is closed on Sundays and most major holidays.  If your order is placed online or with our telephone messaging system on one of these days, we would be pleased to process and deliver the order for you on the next business day.

Same Day Delivery:  We can usually offer same day flower delivery in our local area from Monday through Friday if you place your order before 2:00pm. For same day service on Saturday please order by 12:00 pm. For orders going outside of our local delivery area (ie via transport truck) we cannot guarantee same day delivery.  Please call us if your order is outside these times as we will try to accommodate you if we possibly can.  U.S. orders must be received before 2:00pm in the recipient’s time zone to assure same day delivery.  Orders received after that time will be processed and delivered the next business day.  We will be happy to accept your international orders if you call our shop directly as we are unable to accept international orders through our online store (website).

Request Specific Delivery Times: We are unable to guarantee delivery at a specific time but we are normally able to deliver within four hours on orders. You may request a time frame in the special instruction box when ordering and we will do our best to accommodate your request.  Additional delivery fees may apply for this service.  Specifically timed deliveries are not available on Valentine’s Day or Mother’s Day.

Delivery Times:  Typically our deliveries are made between 10:00am and 3:00pm daily. During major holidays such as Valentine’s Day and Mother’s Day we occasionally operate with extended hours and delivery times.

Weekend Delivery Policy:  As time permits we will schedule Sunday deliveries on Saturday providing we are able to make delivery arrangements with your recipient.  If Saturday delivery can not be confirmed with your recipient then the order will be scheduled for Monday.  You will be contacted first before rescheduling Monday delivery for a Birthday or Anniversary gift.

Funeral Homes:  We give funeral flower orders a very high priority. If you have ordered too late for the delivery to the funeral service we will call as soon as possible to let you know so you can have something sent to the home of the family instead.  If you do not know the exact address of the funeral home we will look it up for you. We normally contact the funeral home to confirm what the family has planned for the day before the funeral and for the day of the funeral service as well as to make arrangements for flower deliveries.  If you have ordered flowers for the day before a funeral or the funeral service day, and that service is to be held on a Sunday, we will deliver to the funeral home on Saturday. 

Recipient Will Be Contacted:  We will always contact the recipient to ensure someone will be home to accept the flower delivery.  For this reason your recipient’s contact information is required on all orders. At the time of our contact we will confirm the delivery address with the recipient.  If the recipient refuses to accept a delivery you may be held fully liable for the cost of the gift.

Request Do Not Call Recipient:  We do not encourage requests to deliver without contacting the recipient however we have made exceptions under certain circumstances.  If we agree to this request and find no one home to accept the delivery, the customer will be charged a delivery fee for each time we attempt a delivery which is unsuccessful.

Request to Leave Item at Door:  The customer assumes all liability for requests to leave items outside.  We highly discourage special instructions requesting delivery to a doorstep, porch, yard or any location where the recipient cannot accept the arrangement themselves. Marquis Flower Shop cannot be held responsible for missing or faulty product if we agree to this special request.

Canceling an Order:  Same day orders are processed immediately and usually cannot be changed. Due to the urgent nature of florist delivered products we are unable to cancel or change orders already in process at the florist, en route or delivered. To cancel or change an order that has not been processed, please call (403) 327-1515.

Card Messages: The message that you write in the Card Message field is the message that is sent with the gift. We do not include any billing information with your order.

Substitutions:  Occasionally substitutions may be necessary to create your bouquet due to the seasonality and availability of our fresh flowers.  Care is taken to maintain the “look and feel” of the arrangement by considering the overall shape, style and color combinations using flowers of equal value. In single flower arrangements, such as an all rose or all orchid bouquet, we will make every attempt to match the flower type but we may substitute with another color of the same variety of flower. 

Plants: For green and blooming plants, similar plants may be substituted of equal or greater value. For one-of-a-kind plants, such as orchids and other blooming plants, we will make every attempt to match the plant type, but may substitute with another color. Containers for plants may not match our picture however they will be as close as can be possible.

Gift Baskets: We may make container and product substitutions within our gift baskets if necessary to guarantee freshness and timely delivery.  Substitutions will be made with items of greater or equal value and will not alter the overall theme or design.

Substitutions for Special Occasions: Due to the importance of delivering orders for special occasions, such as funerals, birthdays, and anniversaries, on specific days, we may make a substitution of equal or greater value to ensure timely delivery, if the flowers you requested are not available, and we are not able to contact you via the phone number(s) or email address you provided us.13
